In these Terms and Conditions of Use, a reference to (4orward Touring) means 4orward Touring (ABN 51 634 707 425).
4orward Touring (hereinafter called the operator), provide the following General Conditions: adequate
Participants vehicle and equipment
All tour participants are required to have a current driver’s licence and commence our tours with a roadworthy registered vehicle (including caravans and/or camper trailers) that have been well maintained, preferably in accordance with the manufacturer’s schedule and which has been inspected and deemed serviceable by an appropriate person prior to departure. All and any other equipment including recovery and camping equipment should also be in a condition and working order and suitable for the journey being undertaken. We accept no responsibility for loss, damage, or theft of or to any property, or repairs or recovery costs to participant’s vehicles or equipment. It is the participant’s responsibility to ensure their vehicle and the equipment carried are suitable for the trip.
Variation to Itinerary
As 4orward Touring operates many of its tours in remote areas, itineraries may be subject to change due to weather and road conditions or any other conditions of an operational nature. As such we reserve the right to alter, and/or cancel any section and/or parts of the itinerary which may result from conditions beyond our control. Every effort will be made to keep to the timetable and the itinerary, but no guarantee will be made that these will be kept.
The operator will not be liable for any costs incurred through failure to connect with any other service. Any personal expenses incurred by the tour participant as a result of any delay, alteration or curtailment of any tour whether caused by weather conditions, mechanical defects or any other causes are the responsibility of the tour participant. In the result of break down or other unforeseen circumstances, the operator has the right to substitute vehicle, vessel or alternative transportation and/or accommodation other than those advertised at any time. If for any reason the itinerary is altered, and/or different itinerary offered, no refund is payable by the operator.
Booked dates for a tour are non-transferable except at the sole discretion of 4orward Touring, and if such changes are consented to by the operator, the customer must choose another date out of the operator calendar for another tour or training session within a 12-month period. No further changes will be accepted nor will refunds be granted. Any fees paid are non-refundable.
The operator shall not in any circumstance be held liable or accept responsibility for any loss, acts, omissions, defaults, accident, mis-deception, delay, failure or expense on the part of other companies, hotel/motel contractors and the like who may provide you with services and facilities at the request of the operator.
Any additional excursions and itineraries as set out will be adhered to where possible. The operator and the tour guide or his agent in charge of the Tour, may make alterations to the itineraries and excursions highlights as they deem fit. Information contained here is correct to the best of the operator’s knowledge, and the operator is not liable for inaccuracies herein, or weather conditions that may influence the limits of your tour and the enjoyment of your tour.
Minimum numbers apply to all our tours.
Health and medical conditions
You should ensure you are in good health as we are regularly travelling in isolated and remote areas where it can be several days before medical help can arrive. If you are unsure, please check with your doctor. Please notify us of any medical condition of which we should be aware. If you are taking medication, ensure you carry adequate supplies for the duration of the tour as well as adequate backup items in case we are delayed due to weather or other unforeseen circumstances. We recommend you also bring a spare or repeats prescription for any medication.
The operator reserves the right without payment or compensation, and whether before or after the commencement of travel, to exclude any tour participant if that tour participant may appear likely to endanger the health or safety or to impair the comfort of other tour participants and may be asked to leave the tour immediately should he/she commit any illegal act.
Liability / Travel Insurance
4orward Touring, its partners and operators accept no responsibility for the loss, theft or damage to personal belongings or luggage, nor for repairs or recovery costs, personal accidents, hospitalisation, illness or medical expenses, nor injury or death to any person, nor any expense subsequently incurred however caused by or arising out of provision of service or failure to provide service.
We strongly recommend tour participants consult their travel or insurance agent prior to departure and take out adequate travel insurance to cover any event and give full travel protection.
Deposit and Payment
Payment will be accepted in cash, credit card or direct credit to a nominated bank account.
Deposits are a minimum of 10% of the total cost of the tour and are required to be made and included as part of any booking. Where the booking is made less than 30 days prior to departure the deposit is to be 60% of the total fee.
50% of the total cost is to be paid 30 days prior to departure.
The balance is payable in full 14 days before departure of a tour.
Tour bookings cancelled more than 45 days prior to departure are refunded less an administration fee of $100. Cancellations between:
- 45-30 days prior to departure – 10% (the deposit) is forfeited
- 29-21 days prior to departure – 30% of the tour fee is forfeited
- 20-7 days prior to departure – 80% of the tour fee is forfeited
- less than 7 days or failure to attend the tour – the full tour fee is forfeited
The operator may use discretion in certain circumstances.
Unused Tour Sectors
If a tour participant fails to join a tour or joins in after departure, or leaves it prior to completion, no refunds can be made.
No refunds will be made in respect of any part of the tour including food, excursions, accommodation, etc., that are not used or undertaken without notification 30 days prior to departure.
